The Netherlands has implemented both Framework Decisions in the so-called “Wet wederzijdse erkenning en tenuitvoerlegging strafrechtelijke sancties 2008”, which translates as the “Law on mutual recognition and execution of financial penalties”.
After the Member States agreed on the text of the Framework Decisions in 2005 and 2006, the Department of Legislation of the Ministry of Security and Justice went to work on the implementation of the Framework Decisions in the Netherlands.
This was a fluent process due to excellent cooperation between the Department of Legislation, the Competent Authority (Public Prosecutor in Leeuwarden) and the Central Authority. This ensured that the Framework Decision on financial penalties was implemented nationally in December 2007.
In June 2009, the law on mutual recognition and execution of financial penalties was amended to incorporate the implementation of the Framework Decision on confiscation orders.
