On the reply form you can state the details of the person who was actually driving the vehicle at the time the violation was established or who was renting/leasing the car at that moment.
If you state the details of a different driver, the CJIB will then write to that person. That person will receive a notification with a reply form.
If the other driver stated acknowledges that he was driving the vehicle concerned at the time of the established offence, the CJIB will treat the case as a new case. That means that the CJIB will first check for recidivism. Depending on the result of that check, the CJIB will send a punitive order and the case will be handed over to the Dutch public prosecution office.
If the driver stated denies that he was driving the vehicle concerned at the time of the established offence, the CJIB again contacts the licence holder, who remains responsible in the end for any offences committed with the vehicle, according to Dutch law. If there is no case of recidivism, the licence holder is allowed to pay the fine according to the punitive order.
If the licence holder continues to deny having been the driver, the CJIB hands over the case to the Dutch public prosecution office.
If the actual driver remains unknown, the case is handed over to the Dutch public prosecution office. The public prosecutor can decide to yet impose a fine on the licence holder or to present the case to the court.
